A recent ruling that could see the top of a near-complete residential tower chopped off stunned the real estate industry. But a judge says the developer should have known better than to continue construction while caught in a legal challenge. In a judgment filed Thursday, Justice W. Franc Perry rejected the argument that invalidating the permit for 200 Amsterdam would be “unduly prejudicial” because the dispute over the building had been going on for years.
